Welcome to TrailForge. By accessing or using TrailForge.biz (the "Site"), subscribing to any membership plan, purchasing any product or guide, or otherwise engaging with our content, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.
By accessing the Site, creating an account, subscribing to any membership tier, or clicking any "I Agree," "Subscribe," "Join," or similar button, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, our Disclaimer & Assumption of Risk, and our Affiliate Disclosure.
These Terms constitute a legally binding agreement between you and TrailForge. We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Site after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
You must be at least 18 years of age to use this Site or subscribe to any membership. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.
Subscription Plans. TrailForge offers paid membership tiers ("Trail Scout" and "Trail Master") with recurring monthly billing. Plan details, pricing, and included features are described on the Site and may be updated at our discretion.
Billing. All payments are processed through Stripe, our third-party payment processor. By subscribing, you authorize TrailForge and Stripe to charge your designated payment method on a recurring basis at the then-current subscription rate. You are responsible for keeping your payment information current.
Cancellation. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. No refunds will be issued for partial billing periods, previously charged periods, or content already accessed.
Price Changes. We reserve the right to change subscription pricing at any time. Existing subscribers will receive at least 30 days' notice before a price change applies to their account.
Failed Payments. If a payment fails, we may suspend or revoke your access to premium content until payment is resolved. We are not responsible for any fees your bank or payment provider may charge as a result of failed or recurring transactions.
All Content on the Site — including but not limited to text, graphics, logos, images, build guides, PDFs, videos, layouts, and design elements — is the exclusive property of TrailForge or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws.
Limited License. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use Content for personal, non-commercial purposes only.
You may NOT: reproduce, distribute, publicly display, sell, resell, share login credentials, republish, or create derivative works from any Content without prior written permission. Sharing premium guides, PDFs, or membership content with non-subscribers is strictly prohibited and may result in immediate account termination without refund.
IMPORTANT: All Content on this Site is for informational and entertainment purposes only. TrailForge does not provide professional mechanical, engineering, automotive, safety, legal, or financial advice. Our guides, recommendations, and build instructions are based on personal experience and opinion — not professional certification or engineering analysis.
Vehicle modifications can affect safety, warranty coverage, emissions compliance, insurance eligibility, and street legality. You are solely responsible for verifying that any modification complies with all applicable federal, state, and local laws, regulations, and manufacturer warranties before performing any work.

You agree that TrailForge, its owners, members, managers, employees, agents, affiliates, partners, and content creators shall NOT be held liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages of any kind, including but not limited to damages for personal injury, death, property damage, lost profits, data loss, or any other damages arising from your use of or reliance on the Site or its Content.
This release of liability applies regardless of the legal theory asserted (negligence, strict liability, breach of warranty, or otherwise) and whether or not TrailForge has been advised of the possibility of such damages.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAILFORGE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE, CONTENT, OR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO TRAILFORGE IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
IN NO EVENT SHALL TRAILFORGE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF TRAILFORGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

We reserve the right to suspend or terminate your account and access to the Site, without prior notice and at our sole discretion, for any reason, including but not limited to: violation of these Terms, sharing premium content, fraudulent activity, abusive behavior, or chargebacks. Upon termination, your right to access premium content ceases immediately. No refunds will be issued for terminations due to Terms violations.
Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State in which TrailForge's LLC is registered, without regard to conflict of law principles.
Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Site shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. You agree to waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.
Class Action Waiver. All claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Small Claims Exception. Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, Disclaimer, and Affiliate Disclosure, constitute the entire agreement between you and TrailForge regarding the use of the Site.
